Barilla Canada ® Restaurant Owner/Operator Outreach Giveaway Official Rules

                                  

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. Eligibility: Barilla® “Restaurant Owner/Operator Outreach” Sweepstakes (the “Sweepstakes”) is open only to legal residents of Canada (excluding Quebec), who are at least the age of majority in their province or territory of residence at the time of entry and are employed as restaurant owners or operators in the food service and hospitality space, or were recently employed as restaurant owners or operators and had employment impacted due to events of COVID-19. Employees of Barilla Canada, Inc. (“Barilla”), its parent and affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, provincial, and local laws and regulations and is void where prohibited. This promotion rewards a total of four entrants, with one entrant living and working in the West (British Columbia or Alberta), one entrant living and working in the Prairies or Territories (Saskatchewan, Manitoba, Yukon, Northwest Territories or Nunavut), one entrant living and working in Central Canada (Ontario) and another entrant living and working on the East Coast (New Brunswick, Newfoundland and Labrador, Nova Scotia and Prince Edward Island). One eligible winner will be randomly awarded from each of the four regions. If a participant is selected as the random winner of one of the four regions but does not abide by the entrant requirements or eligibility requirements, Barilla reserves the right to grant prizing to the next eligible party who meets all entrant and eligibility requirements. Qualifiers include: heading to https://bit.ly/3fGK3v5 (a Google form) to submit an entry and provide name, restaurant name that entrant owns or operates, a link to the restaurant website, specify their region of residence and business, upload Barilla recipe submission (including recipe name, a photo and full recipe), proof of employment and contact details. Entry must be complete to be considered valid. Entrant MUST verify that they are a restaurant owner or operator either by uploading a paystub from the last month or providing the name, title and contact info of a reference from their restaurant who can confirm their status, or by providing a letter of employment. This proof of employment MUST be verified in order for participant to be considered eligible. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Sweepstakes begins on December 1, 2020 12:00 a.m. Eastern Time ("ET") and ends on December 15, 2020 at 11:59 p.m. ET (the "Promotion Period"). The Promotion is active for an fifteen (15) day period, as outlined in the chart below:

Sponsor’s computer is the official time-keeping device for the Sweepstakes.

4. How to Enter: The Sweepstakes must be entered by entrants submitting an entry via this online form: https://bit.ly/3fGK3v5. All details outlined in the submission form must be present in order for an entry to be eligible. If a potential entrant has any questions or concerns prior to submitting their entry, they may outline them in an email to [email protected]. The entry must fulfill all Sweepstakes requirements addressing all questions on the form which include providing provide name, restaurant name that entrant owns or operates, a link to the restaurant website, specify their region of residence and business, upload Barilla recipe submission (including recipe name, a photo and full recipe), proof of employment and contact details. Again, to be eligible, entrant must provide proof of employment as a restaurant owner or operator. Entrant will automatically receive one (1) entry into the Sweepstakes for this entry. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor, sponsor affiliates, agencies, and/or partners.

Limit: You may enter one (1) time per the Promotion Period. Multiple entrants are not permitted to enter. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email account used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned to the email account. All entries and materials associated with your entry must be in accordance with the applicable terms, rules, policies, and guidelines of Instagram.

5. Drawings: All decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Sponsor will select the four (4) Sweepstakes winners [one (1) randomly from each of the four regions, West (British Columbia or Alberta), Prairies or Territories (Saskatchewan, Manitoba, Yukon, Northwest Territories or Nunavut), Central Canada (Ontario) and East Coast (New Brunswick, Newfoundland and Labrador, Nova Scotia and Prince Edward Island)] who submit eligible entries during the applicable Promotion Period on or around the dates listed in Section 3 above. The potential winners will be notified by email message or phone. If a potential winner of any prize cannot be contacted or fails to respond within seven (7) business days of the initial email response asking them to provide details to verify their employment information, the potential winner forfeits his/her prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a potential winner is disqualified for any reason, or if participant is not deemed eligible due the parameters outlined here, the next eligible entrant who meets all of the requirements in that region will be selected as the winner in that region. If four total entrants (one from each of the four regions outlined above) do not meet all eligibility requirements ahead of the deadline, prizes may remain un-awarded. Prizes will begin to be fulfilled immediately within sixty (60) days after the conclusion of the Sweepstakes. In order to be awarded the $5000 prize, once eligibility requirements have been verified, entrants will need to fill in an online form providing contact and direct deposit information so that prize can be directly deposited into account. Receiving prize funds may take up to 60 (sixty) days. Failure to submit this form with accurate and up to date information, may result in entrant being deemed ineligible, disqualified and a new eligible entrant selected.

6. Prizes:

  • FOUR (4) rewards of $5,000 CAD deposited directly into four different entrants banking accounts pending participant meets the entrant requirements. Of the four total winners, one will be from the West (British Columbia or Alberta), another form the Prairies or Territories (Saskatchewan, Manitoba, Yukon, Northwest Territories or Nunavut), another from Central Canada (Ontario) and another from the East Coast (New Brunswick, Newfoundland and Labrador, Nova Scotia and Prince Edward Island).

Primary winners (4 different entrants) will each receive $5,000 deposited into their banking account in order to offset any potential financial challenges due to COVID-19.

For Prize: Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received during the applicable Promotion Period. Limit: one (1) prize per person. Sponsor accepts no responsibility for any variation in the prize value.

7. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

8. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccuracies, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

9. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of legal action, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Ontario without giving effect to any choice of law or conflict of law rules (whether in Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the province of Ontario.

11. Winners List: To obtain a copy of Winners names or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Barilla (Canada), 140 Allstate Parkway, Unit 200, Markham, ON, Canada, L3R 5Y8. Requests must be received no later than [January 29, 2020, at 11:59 p.m., ET].

12. Social Media: The Sweepstakes hosted by Sponsor is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram.

13. By submitting an entry, you, the participant, have affirmatively reviewed, accepted, and agreed to all of these Official Rules.
