EU-US Privacy Shield and Swiss-US Privacy Shield Certification
The following information aligns Barilla’s Statement of Privacy with the specific points required by the Privacy Shield self-certification process, and ensures Barilla’s compliance with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework. Barilla complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union member countries and Switzerland to the United States, respectively. Barilla has certified that it adheres to the Privacy Shield Principles. If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the EU-US and Swiss-US Privacy Shield Principles, Barilla commits to resolve complaints about your privacy and our collection or use of your personal information. Barilla has committed to cooperate with the EU authority or authorities concerned under the EU-U.S. Privacy Shield Framework and/or the Swiss Federal Data Protection and Information Commissioner under the Swiss-U.S. Privacy Shield Framework, in conformity with the Supplemental Principles on Human Resources Data and the Role of the Data Protection Authorities and will comply with the advice given by such authorities.
Barilla has further committed to refer unresolved privacy complaints under the EU-US and Swiss-US Privacy Shield Principles to an independent dispute resolution mechanism, BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint.
Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.
Barilla is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).
To the extent provided by the Privacy Shield Principles, Barilla remains responsible and liable under the Privacy Shield Principles if a third-party that it engages to process personal information on its behalf does so in a manner inconsistent with the Privacy Shield Principles, unless Barilla proves that it is not responsible for the matter giving rise to the damage.
